1. Agreement to Our Legal Terms
Welcome to Phi Art (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website, services, and platform (collectively, the “Services”). By accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree, do not use our Services.

3. User Eligibility
Users under 13 years old may use the platform without parental consent. By using our Services, you represent you have the legal capacity to agree to these Terms.
4. Intellectual Property Rights
We own or license all intellectual property rights to website content, including source code, logos, trademarks, graphics, and text (“Content”). Content is provided “AS IS” for personal, non-commercial use only.
Artists retain ownership rights to their own artworks (paintings, sculptures, NFTs, etc.) uploaded to the platform. You may not use any Content or artwork for commercial purposes without explicit permission.
5. User Submissions and Contributions
By submitting feedback or content (“Submissions”), you grant us a worldwide, royalty-free license to use, distribute, reproduce, and display such Submissions. This license does not apply to your art unless explicitly submitted for other purposes.
Users warrant that their Submissions do not infringe third-party rights and comply with all laws.
6. Payment, Purchases, and Refunds
We accept payments via PayPal, MasterCard, Apple Pay, Zelle, and Venmo. No refunds or returns are accepted once an artwork has shipped.
Cancellation requests must be emailed within 7 days of purchase and only apply if the item has not shipped. Purchased artwork shipping insurance is available optionally.
7. Cookies and Tracking
By using our Services, you consent to our use of cookies for functionality, analytics, and marketing. Users may opt out of cookies by contacting us via email. A detailed cookie policy is forthcoming.
8. Privacy of Personal Information
We collect personal information including names, emails, phone numbers, payment and shipping details, and browsing data to provide, improve, and personalize our Services.
We comply with the California Consumer Privacy Act (CCPA). Users have rights to access, delete, and opt out of sale of personal data by contacting us. Data is retained for one week after account closure and deletion requests finalized within two weeks.
9. Prohibited Activities
Users agree not to engage in activities that are illegal, harmful, offensive, infringe intellectual property, or disrupt our Services. Violation may result in suspension or termination.
10. Limitation of Liability
Phi Art is not liable for indirect, incidental, or consequential damages arising from your use of the Services. Our Services are provided “AS IS” without warranties of any kind.
11. Dispute Resolution and Governing Law
These Terms are governed by the laws of California, USA. Disputes will be resolved in California courts or via binding arbitration per California law.

We reserve the right to update these Terms upon notice posted on our website or via email. Continued use indicates acceptance.
